Terms and conditions
This English version is provided for convenience. The German version is legally binding.
§ 1 Scope
These general terms and conditions apply to all orders placed by consumers and businesses via the online shop of YOUR MASK GmbH. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (Section 13 BGB). A business is any natural or legal person or partnership with legal capacity acting in the exercise of its trade, business or profession (Section 14 BGB).
Deviating terms of the customer apply only if we expressly agree to them in writing.
§ 2 Contracting party
The purchase contract is concluded with YOUR MASK GmbH, Saalmannstraße 7–9, Haus 7, 13403 Berlin, Germany. Contact: phone +49 30 46 79 59 83, email info@yourmask-berlin.de.
§ 3 Conclusion of contract
The presentation of products in the online shop is not a legally binding offer but an invitation to order. You can add products to the cart and enter your details at checkout. Before submitting, you see all details again and can correct input errors. By clicking the order button at the end of the checkout (“Zahlungspflichtig bestellen”, order with obligation to pay), you submit a binding offer to purchase the goods in the cart.
Immediately afterwards, you receive an order confirmation from us by email. With this order confirmation we accept your offer, and the contract is concluded. If you choose a payment method where payment is triggered immediately (such as PayPal, credit card, Apple Pay, Google Pay or Shop Pay), the contract is concluded at the latest with this payment.
Product images show the type of pack. The contents, quantity and marking of the goods are set out in the product description.
§ 4 Contract language and storage of the contract text
The contract language is German; this English version is provided for information. We store the contract text. With the order confirmation, you receive the order details, the withdrawal instructions including the model withdrawal form and a link to these terms by email. You can access, save and print these terms on this page at any time. If you ordered while signed in, you will also find your orders in your customer account.
§ 5 Prices and shipping costs
All prices are final prices and include statutory VAT. Shipping costs are added; you can find them under Shipping and payment and at checkout. Prices apply per pack. For pallets and other bulk orders, we prepare individual quotes; the conditions stated there apply.
§ 6 Payment
You can pay with PayPal, Klarna, credit card, Apple Pay, Google Pay or Shop Pay. The terms of the respective payment provider apply. For businesses and institutions, purchase on invoice is possible by prior arrangement; unless otherwise agreed, invoices are payable within 14 days of the invoice date without deduction.
§ 7 Delivery
Through the online shop we deliver to Germany, Austria and Switzerland. The delivery time is 1–3 working days within Germany, 2–4 to Austria and 3–5 to Switzerland unless stated otherwise on the product. If an ordered item is not available, we will inform you without undue delay and refund any payments already made.
§ 8 Retention of title
The goods remain our property until paid in full. With respect to businesses, we retain title until all claims arising from the ongoing business relationship have been settled.
§ 9 Right of withdrawal
Consumers have a statutory right of withdrawal. Details can be found in the withdrawal information, where you can also withdraw from the contract directly online.
§ 10 Warranty
The statutory rights in respect of defects apply. For businesses, the limitation period for claims for defects is one year from delivery; businesses must inspect the goods without undue delay after receipt and report defects without delay (Section 377 HGB).
§ 11 Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the Product Liability Act. In the event of a slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable damage typical of the contract. Otherwise, liability for slight negligence is excluded.
§ 12 Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory consumer protection provisions of the state of their habitual residence. If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Berlin.
